One can face this punishment if he access a data or information system for dishonest purpose. But the problem is the word ‘dishonest’ as what could be described as dishonest and how honesty or dishonesty could be proved.
Punishment: up to 3 Months Prison or up to Rs. 50,000 Fine or both
Examples:
- Accessing a data means to control or the ability to use data like SMS, email, print out, fax or computer data
- Accessing an information means to controlling or the ability to use any electronic system including mobile phone, tablet, laptop etc.
